These Terms of Service govern access to and use of the Flourish mobile application and related services (the Service), operated by Outpost Collective LLC. By creating an account, accessing, or using Flourish, you agree to these Terms.
1. Eligibility
Flourish is intended for adults age 18+ who are parents, guardians, or caregivers of children ages 0-3. Children may not create accounts or directly use the Service.
2. What Flourish Is
Flourish is an educational and informational app with personalized Play Plans, milestone and tracking tools, and caregiver guidance. Flourish is not a medical device.
3. Medical and Therapy Disclaimer
Flourish does not provide medical advice, diagnosis, treatment, or therapy services. No therapist-patient relationship is created through app use. For concerns about a child's health or development, consult a licensed healthcare professional.
4. Accounts and Child Profiles
Account holders are responsible for account security and all activity under their account. Child profiles are entered and controlled by the adult user and may include nickname, date of birth, and developmental logs.
5. Consulting Call Funnel
Flourish may include a funnel to request informational consulting calls. These calls are educational only and do not constitute therapy, medical advice, or diagnosis. Any recommendations are play and activity guidance intended to support development in children ages 0-3.
6. Subscriptions and Billing
Flourish provides a 14-day free trial, followed by a $5.99/month subscription unless canceled. Billing, renewals, cancellations, and refunds are handled by the Apple App Store or Google Play under their policies.
7. Intellectual Property
All Flourish content, including activity content, milestone frameworks, questionnaires, copy, and branding, is owned by Outpost Collective LLC or its licensors. Unauthorized reproduction, scraping, reverse engineering, or commercial reuse is prohibited.
8. Acceptable Use
Do not misuse the Service, interfere with operations, attempt unauthorized access, or use Flourish in violation of applicable law.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTPOST COLLECTIVE LLC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE.
11. Indemnification
You agree to indemnify and hold harmless Outpost Collective LLC from claims, losses, or liabilities arising from your misuse of the Service or violation of these Terms.
12. Dispute Resolution, Arbitration, and Class Action Waiver
Before formal action, you agree to attempt informal resolution by contacting us at hello@flourishkids.app. Except for matters eligible for small claims court, disputes will be resolved by binding individual arbitration. You waive participation in class or representative actions to the fullest extent permitted by law.
13. Governing Law
These Terms and any dispute relating to Flourish are governed by the laws of the State of Wisconsin, without regard to conflict-of-laws principles.
14. Changes to These Terms
These Terms may be updated periodically. Continued use of Flourish after updates constitutes acceptance of revised Terms.
